Welcome to CLUB DARQ (and CLUB LYTE, our light, lit sister). These Terms & Conditions apply to everyone who books a class, buys a membership, or joins a workout with us. By signing up, you agree to the following terms. They’re here to keep things clear, safe and fair for everyone.

These Terms and Conditions (the Terms) apply to all Memberships, Class bookings, Credit purchases, workshops, events, personal-training sessions, Gift Cards, and other Services purchased from Club DarQ B.V., trading as CLUB DARQ and CLUB LYTE (together, we, us, or our).
These Terms apply alongside the price, Membership description, booking rules, and any product-specific conditions shown to you before purchase. Where product-specific conditions conflict with these Terms, the product-specific conditions apply to that product, unless mandatory law provides otherwise. Nothing in these Terms limits rights that you have under mandatory law.

| Services | Our Classes, Memberships, Credits, events, workshops, personal-training sessions, digital booking tools, and related studio services. |
You must provide accurate, current, and complete information when creating an account or making a purchase, and you must keep your contact and payment details up to date. You are responsible for activity performed through your account unless you promptly notify us of unauthorised use.
An agreement is formed when we confirm your purchase or booking. You must be at least 18 years old to enter into an agreement with us, including a Membership agreement.
Participants aged 14 to 17 may use our Services, subject to the age-related rules in Section 13. For a participant aged 14 to 17, the account must be created, and any Membership must be entered into, by a parent or legal guardian, who acts as the contracting party and remains responsible for all obligations under the agreement, including payment. Once such an account has been created, the participant aged 14 to 17 may independently purchase individual Credits and book Classes under that account.
Your account, Membership, Credits, and booking access are personal to you, or, where applicable, to the participant for whom a parent or legal guardian has created the account. They may not be sold, assigned, transferred, or shared, except where Club DarQ B.V. expressly agrees otherwise in writing.
Unless the Membership description expressly states an agreed fixed initial term, Memberships run on recurring four-week Membership Periods and renew automatically until cancelled in accordance with this Section. The first payment is due at the time of purchase. Future Membership Periods may be collected approximately one week before the start of the relevant Membership Period; the Membership Period itself remains unchanged regardless of the collection date.
You may cancel your Membership at any time by emailing info@clubdarq.com. A notice period of four weeks applies. To ensure that your Membership ends at the end of the Membership Period or commitment period you wish to terminate, we must receive your cancellation notice at least four weeks before that period ends. We will confirm your cancellation by email.
The following Memberships have a fixed initial commitment period, which will be clearly stated on the website, product page, and at checkout before purchase:

During an agreed fixed initial commitment period, cancellation will take effect at the end of that commitment period, unless the applicable product terms or mandatory law provide otherwise.
Members may upgrade their Membership at any time. Where applicable, we will calculate any price difference proportionately for the remainder of the current Membership Period and communicate the amount before the upgrade takes effect. A downgrade may take effect at the end of the current Membership Period or, where an agreed fixed initial term applies, at the end of that commitment period. The availability, eligibility requirements, and price of an upgrade or downgrade will be shown in the booking system or confirmed by us before the change is made.
Memberships cannot ordinarily be paused or cancelled part-way through a Membership Period. This does not affect any right of withdrawal, termination, suspension, refund, or other remedy that mandatory law gives you. We may consider a pause or extension in exceptional circumstances at our discretion; this must be confirmed by us in writing to be valid.
Classes must be booked through the CLUB DARQ or CLUB LYTE booking tools, including the TrainIn app or our website, unless we tell you otherwise. A booking is personal to the Member who made it. Entry may be refused if the booked Member cannot be identified or if a booking was made in breach of these Terms.
A Credit booking uses one Credit. A Member with a limited Membership may use a Credit or Class allowance in accordance with the product description. An Unlimited Membership is subject to the daily maximum, Studio capacity, booking availability, and the late-cancellation and no-show rules below.
You may cancel a Class booking free of charge up to 12 hours before the scheduled start time. Where you cancel later than 12 hours before the start time, one Credit or Class allowance will normally be deducted and will not be refunded. The CLUB LYTE late-cancellation fee in Section 4.4 applies instead where a CLUB LYTE Membership booking is subject to that rule. The CLUB DARQ Unlimited Membership rules in Section 4.4 also apply instead where relevant.
If you arrive after a Class has started, entry is not permitted. A late arrival may be treated as a no-show for the purposes of Section 4.5.
We ask Members to cancel promptly so that other Members can use available capacity. A late cancellation occurs where you cancel less than 12 hours before the scheduled start time.

In case of a '1 Credit per week' - Membership, your Credit will be lost when cancelling too late, just like it is the case when purchasing individual Credits.
Late-Cancellation Fees will be collected using the payment method linked to your Membership. If you have provided a valid SEPA direct-debit mandate, we may collect the applicable fee by automatic direct debit. If no valid direct-debit mandate is available, we will send you a payment request.
If a Late-Cancellation Fee is not paid, or if a valid payment is reversed or charged back, we may temporarily freeze access to your Membership until the outstanding amount has been paid. If you believe a fee was charged in error, please contact us promptly at info@clubdarq.com.
A no-show occurs when you do not attend a booked Class. The following no-show fees may be charged:

In case of a '1 Credit per week' - Membership, your Credit will be lost when you haven't showed up for Class, just like it is the case when purchasing individual Credits.
No-Show Fees will be collected using the payment method linked to your Membership. If you have provided a valid SEPA direct-debit mandate, we may collect the applicable fee by automatic direct debit. If no valid direct-debit mandate is available, we will send you a payment request.
If a No-Show Fee is not paid, or if a valid payment is reversed or charged back, we may temporarily freeze access to your Membership until the outstanding amount has been paid. If you believe a fee was charged in error, please contact us promptly at info@clubdarq.com.
If a Class is full, you may join its waitlist through the booking system. A place may be automatically confirmed up to 60 minutes before the Class begins. Once your place has been confirmed, the normal cancellation and no-show rules apply.
We will normally send an app notification and, where enabled, an email when a waitlist place is confirmed. Email notifications are only sent if you have enabled the 'Newsletter' preference within your TrainIn account or app settings. Push notifications are only sent if you have enabled notifications for the CLUB DARQ / CLUB LYTE app on your device.
These notifications are provided as a courtesy only. You remain solely responsible for monitoring your booking status within the app, regardless of whether you receive a notification.
If you no longer wish to attend, you must remove yourself from the waitlist before your booking is confirmed or, if your place has already been confirmed, cancel your booking within the applicable cancellation window.
You must check in for every Class by scanning the QR code in your CLUB DARQ & CLUB LYTE app at the reception iPad. Check-in is personal to you and remains your responsibility, even if you have attended the Class.
If you attend a Class but miss the QR-code check-in, ask your instructor immediately after the Class to verify and record your attendance. If this is not possible, email info@clubdarq.com within 24 hours after the scheduled Class. We will review the available attendance records and correct a check-in where appropriate.
If you do not check in and do not report the missed check-in within the above period, the booking may be recorded as a no-show and the applicable no-show fee may be charged. A failure of the check-in system or another clear technical error will be reviewed reasonably when reported promptly.
Unless we communicate otherwise, the Studios are closed on Christmas Eve (24 December), Christmas Day (25 December), Boxing Day (26 December), New Year's Eve (31 December), and New Year's Day (1 January).
The Studios are also closed for the Brabant Carnival period from Thursday through Monday. Carnival dates change each year, and the applicable dates will be shown in the app and our booking system.
For other public holidays, including Easter, Whit Monday, Ascension Day, and the day after Ascension Day, we normally operate a weekend schedule. This usually means morning Classes only, with Classes scheduled later into the morning than on an ordinary weekday. The current holiday schedule shown in the booking system prevails.
These closures and holiday schedules form part of the Services and are taken into account in the Membership offering. They are subject to the reasonable-access and mandatory-law protections in Section 5.2.
We do everything we can to offer a consistent, high-quality schedule. At the same time, we're a living, growing studio and sometimes things need to change.
This means we may update our Class schedule, Class times, instructors, workout concepts, Studio allocation, opening hours or other parts of our Services. This may happen due to seasonal schedules, holidays, instructor availability, maintenance, technical issues, events, safety considerations or other operational reasons.
As part of our annual operations, CLUB DARQ and CLUB LYTE operate a Summer Recess Schedule during July and August. During this period, the Class schedule may be temporarily adjusted to reflect seasonal attendance patterns, instructor availability and warmer weather conditions.
These seasonal adjustments help us maintain a reliable Class schedule by improving Class occupancy and reducing the likelihood of Classes being cancelled due to low attendance. This allows us to provide Members with a more consistent experience throughout the summer period. During periods of higher temperatures, Classes may also be shifted towards the early morning or evening to provide a more comfortable and enjoyable Member experience.
Your Membership gives you access to the current Services and Class schedule offered by CLUB DARQ and/or CLUB LYTE. It does not guarantee a fixed schedule, a specific number of Classes, a particular instructor, workout concept or specific Class times throughout the duration of your Membership.
Temporary or permanent changes to our schedule or Services, including our annual Summer Recess Schedule, do not entitle Members to refunds, discounts, compensation or suspension of Membership, provided that Members continue to have reasonable access to the core Services included in their Membership.
If Classes need to be cancelled, rescheduled or adjusted due to circumstances beyond our reasonable control, or where necessary to protect the safety, health or experience of our Members or team, we will always do our best to minimise disruption and communicate changes as soon as reasonably possible.
You must not share your account, login details, Membership, Credits, booking access, or any other entitlement with another person, including friends, partners, or acquaintances. You must keep your login details secure and notify us promptly if you believe that another person has accessed your account.
If we reasonably determine that unauthorised sharing or use has occurred, we may take proportionate steps to protect capacity, fairness, and service quality. These steps may include refusing entry to an unauthorised participant, temporarily suspending the Member's account, cancelling an affected booking, and requiring the unauthorised participant to purchase a Drop-In Class before participating.
Where an unauthorised participant has used a Member's account, we may charge the Member a contractual fee of €50, provided that the fee is lawful, proportionate, clearly disclosed, and appropriate in the circumstances. We will tell the Member the reason for the measure and the amount due. We may reactivate an account once any properly due amount has been paid and the issue has been resolved.
Serious or repeated misuse may lead to suspension or termination of the Membership in accordance with applicable law. Any fixed-term payment obligation may continue only to the extent permitted by law and the agreement that was clearly presented at purchase.
Credits are valid only for the validity period clearly displayed before purchase and in your TrainIn account. Unused Credits expire at the end of that period and cannot be refunded, exchanged for cash, or reinstated.
Credits are personal to the purchaser or the Member to whom we have expressly assigned them. They may not be sold, transferred, shared, exchanged, or used by another person without our prior written consent.
DARQ Credits may be used for CLUB DARQ concepts, and LYTE Credits may be used for CLUB LYTE concepts, in each case subject to the product description visible before purchase. One Credit normally equals one Class.
Promotional offers, introductory Memberships, referral campaigns, First-Time Packages, and other special offers may be subject to additional terms and conditions. These may include different validity periods, usage conditions, renewal conditions, eligibility criteria, expiry dates, or booking restrictions. Any applicable conditions will be communicated clearly when the offer is made available.
A First-Time Package, or another offer expressly limited to new customers, may be purchased only once by the eligible individual. Eligibility is personal and is not determined solely by an email address, account, phone number, payment method, or device.
You must not create or use a duplicate account, alternative email address, or other means to deliberately obtain a First-Time Package or other new-customer offer more than once. If we reasonably determine that a person has deliberately circumvented these rules, we may cancel the duplicate promotional purchase, close or consolidate the duplicate account, suspend booking access, and require payment of the difference between the promotional price and the applicable standard price.
We may consider a reasonable extension where a Member is unable to use Credits because of injury, illness, pregnancy, or another substantial medical reason. We may request reasonable evidence, but you should not send detailed medical records or other health information that is unnecessary for the request. Any information you provide will be handled in accordance with our Privacy Notice.
Personal-training sessions, workshops, events, special Classes, and other one-time Services may have separate prices, eligibility requirements, cancellation windows, and refund rules. We will present the applicable terms clearly before you commit to purchase. Where those specific terms conflict with these Terms, the specific terms apply to that one-time Service.
The current price of each Membership, Credit pack, event, workshop, Gift Card, or other Service is shown in the booking system or on our website before purchase. All fixed, unavoidable charges, including any registration fee, must be displayed clearly before you place an order. Prices include VAT unless we state otherwise clearly before purchase.
A one-off registration fee of €75 is charged for each new Membership subscription. This fee covers onboarding and subscription-administration costs. It does not apply when you upgrade or downgrade an existing Membership.
If a Membership is cancelled and later reactivated or newly purchased, it is treated as a new subscription and the registration fee may be charged again. The registration fee and its amount will be shown clearly before you complete your purchase.
The first Membership payment is made at purchase via iDEAL. Where the checkout flow requests it, completion of the first payment also creates the SEPA direct-debit mandate for future Membership payments on the terms disclosed at checkout.
Recurring Membership payments are collected approximately one week before the start of each new Membership Period. You are responsible for ensuring that the designated bank account contains sufficient funds on the scheduled collection date.
Credits and Gift Cards must be paid in full at the time of purchase. Available payment methods are shown at checkout and may include iDEAL and credit card.
Personal Training is invoiced monthly in arrears. The applicable invoice must be paid in accordance with the payment terms stated on that invoice.
Private Events and Private Classes are invoiced separately. A deposit equal to 50% of the agreed price must be paid in advance to confirm the booking. The remaining 50% will be invoiced after the Private Event or Private Class and must be paid in accordance with the payment terms stated on the invoice.
Unless we state otherwise before purchase, other one-time Services must be paid in full at the time of purchase.
To keep Membership pricing transparent and predictable, we may apply an annual Membership indexation once per calendar year, effective on or around 1 January. The annual indexation will be based on the percentage change in the most recently published Dutch Consumer Price Index (CPI, All Households) by Statistics Netherlands (CBS). If CBS replaces that index, we may use a comparable official successor index.
The CPI-based adjustment reflects changes in the cost of operating the Studios, including wage developments, rent, utilities, instructor development, facilities, and related reasonable business costs. We will tell Members at least 30 days before the adjusted price takes effect. The notice will state the new price, the effective date, and the calculation basis.
Any increase that is not a straightforward application of the stated CPI formula will be treated as a separate price change. We will explain the reason for it, give at least 30 days' notice where reasonably possible, and preserve any right to cancel or terminate that mandatory law gives the Member.
If an automatic payment fails because of insufficient funds or another payment issue, we may make one further attempt to collect the amount due. We will notify you and give you an opportunity to resolve the failed payment.
If payment is not received within three days after our notification, we may temporarily suspend access to the Membership until all outstanding amounts have been paid. Suspension does not by itself end the Membership agreement or remove a Member's payment obligations. We will restore access once payment has been received, subject to reasonable processing time.
If you reverse or charge back a valid payment without first contacting us to resolve the issue, we may charge an administration fee of €20 in addition to the outstanding balance, but only to the extent permitted by law and where the fee is clearly disclosed before purchase. You may contact us promptly if you believe a charge was incorrect.
Before charging statutory collection costs to a consumer or commencing formal collection steps, we will follow the legally required notice and payment-reminder process, including any applicable free 14-day payment notice. We may recover properly due amounts using appropriate collection procedures where necessary.
If you enter into a Membership or purchase another Service online, you may have a statutory right to withdraw from the agreement within 14 days without giving a reason.
To exercise this right, send us a clear statement by email to info@clubdarq.com or use the model withdrawal form in Schedule 1. You may also use any other unambiguous statement that identifies the agreement from which you wish to withdraw.
If you ask us to begin providing the Services during the 14-day withdrawal period, you expressly request immediate performance and agree that, if you later withdraw, you will pay the proportionate amount for the Services actually supplied before we receive your withdrawal notice. The checkout flow must obtain this express request and clearly explain the amount or method of calculation before the Service begins.
Where a Service has been fully performed during the withdrawal period, the right of withdrawal may end only where you expressly agreed in advance to immediate performance and acknowledged that you would lose the right of withdrawal once the Service was fully performed. We will refund amounts properly due after withdrawal within the period required by law.
To protect safety, hygiene, and the experience of all Members, you must follow the reasonable instructions of our team and comply with the Studio rules below.
Shoe-free Studio and hygiene. Our Studios are shoe-free. You must remove outdoor shoes immediately at the entrance and must not walk through the entrance or Studio areas in them. Store your outdoor shoes in a locker or in the shoe cabinet beside the entrance.
Grip socks. Grip socks are mandatory for all Classes in Studio 3 (CLUB LYTE) and all Classes in Studio 2 (CLUB DARQ): DARQ BARRE, DARQ PILATES, PILATES x STRENGTH, DARQ BOOTY & DARQ STRENGTH.
Footwear and cycling equipment. For DARQ RIDE Classes in Studio 1, cycling shoes are available to borrow. You may also bring your own SPD-compatible cycling shoes or clean indoor workout shoes. We cannot guarantee that a particular cycling-shoe size will be available, so you must bring clean indoor workout shoes as a backup.
Towels. You must use a towel during your workout. Towels are provided by the Studio unless we notify you otherwise.
Conduct. Smoking, pets, disruptive behaviour, harassment, intimidation, and conduct that threatens safety or seriously disrupts a Class are not permitted. We may refuse entry or ask a person to leave where this is reasonably necessary for safety, hygiene, or the experience of other Members.
Punctuality. Late entry is not allowed once a Class has started. This protects the safety and experience of everyone in the Class.
Children and young people. Participants must normally be at least 14 years old. For a participant aged 14 to 17, the account must be created, and any Membership must be entered into, by a parent or legal guardian, in accordance with Section 3.
A participant aged 14 or 15 may take part only with the prior consent and responsibility of a parent or legal guardian. Unless we expressly agree otherwise in writing, the parent or guardian must remain present in or immediately available at the Studio for the full visit.
A participant aged 16 or 17 may take part independently, without a parent or guardian present, provided that the account has been created by a parent or legal guardian in accordance with Section 3.
Children under 14 are not permitted in the Studio unless we have expressly made a specific programme available to them. Children may not wait unattended in or around the Studio while a parent or guardian participates in a Class. These rules are intended to maintain a safe, focused, and professional Studio environment.
Participation in Classes is voluntary and you take part at your own level and responsibility. You must decide whether you are fit to participate, follow instructor safety directions, use equipment correctly, and stop exercising if you feel unwell, dizzy, or in pain. Where appropriate, seek independent medical advice before participating.
If you have an injury, illness, pregnancy-related concern, or other health issue that may affect safe participation, tell the instructor only what is necessary to help them provide safe practical guidance. We do not provide medical diagnosis or treatment, and instructors cannot assess whether participation is medically suitable for you.
You are responsible for loss or damage that you intentionally cause or cause through negligence to our Studios, equipment, or property. We are not responsible for personal belongings brought into the Studio unless we are legally responsible for their loss or damage. Lockers are provided for convenience only and do not create a duty of safekeeping.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that rule, Club DarQ B.V. is liable only to the extent that injury, loss, or damage is caused by our attributable failure, unlawful act, or another circumstance for which we are legally liable.
Club DarQ B.V. processes personal data when you create an account, make a booking, purchase Services, contact us, or use the booking system. Our Privacy Notice explains who is responsible for your data, the purposes and legal bases for processing, the categories of data used, retention periods, recipients, your rights, and how to contact us about privacy.
You can find the current Privacy Notice at https://www.clubdarq.com/privacy and https://www.clublyte.com/privacy. Where health information is provided to us, we will process it only where permitted by applicable data-protection law and only for the specified purpose for which it is needed.
CLUB DARQ and CLUB LYTE primarily communicate important operational updates through the CLUB DARQ / CLUB LYTE app (powered by TrainIn).
These updates may include, but are not limited to:
We strongly recommend enabling push notifications for the CLUB DARQ / CLUB LYTE app, as this is the fastest way to receive important updates.
The same operational updates can also be sent by email. However, due to the settings of the TrainIn platform, these emails are only sent if you have enabled the 'Newsletter' preference within your TrainIn account or app settings. Although this setting is labelled as 'Newsletter', it is also used to deliver important operational communications relating to your Membership and bookings.
It is your responsibility to keep your account details up to date, enable app notifications and ensure that the 'Newsletter' preference remains enabled if you wish to receive operational updates by email.
Members remain responsible for monitoring the app and the email address linked to their account. CLUB DARQ and CLUB LYTE cannot be responsible for missed operational communications resulting from disabled notifications, disabled email preferences, incorrect contact details or circumstances outside our reasonable control.
Members are deemed to have received operational communications once they have been made available through the CLUB DARQ / CLUB LYTE app and, where applicable, sent to the registered email address in accordance with the Member's communication preferences.
From time to time, we may also use these communication channels to inform Members about special events, new Services, promotional offers or other CLUB DARQ and CLUB LYTE news. Such communications will always remain limited and relevant to our community.
If you have a complaint, question, or feedback, contact us at info@clubdarq.com. Please include enough information for us to identify the relevant Membership, booking, payment, or incident.
We aim to respond within four weeks. If we need more time to investigate, we will tell you and provide an expected response date. This complaints process does not affect your right to seek a remedy through any competent court or consumer body available to you under applicable law.
All intellectual-property rights in our website, app content, branding, Class formats, Studio materials, videos, images, text, and other content belong to Club DarQ B.V. or its licensors. You may use that content only for your personal, non-commercial use of the Services. You must not copy, reproduce, publish, distribute, record, stream, or commercially exploit it without our prior written permission, except where mandatory law allows this.
We may change these Terms where this is reasonably necessary because of changes in law, safety requirements, technology, booking systems, our Services, or legitimate operational needs. We will not use this right to make arbitrary changes or to remove mandatory consumer rights.
For a material change that negatively affects a Member, we will give at least 30 days' notice by email, in the app, or by another durable medium, unless a shorter period is required for legal, safety, or urgent security reasons. The notice will state what is changing, when it takes effect, and any right to cancel or terminate that mandatory law gives you.
The latest version of the Terms will be available on our website. Continuing to use the Services after the effective date of a properly notified change will constitute acceptance only to the extent permitted by law.
If an event outside our reasonable control prevents or materially delays us from providing the Services, we may suspend or adjust the affected Services for as long as reasonably necessary. Such events may include government action, severe weather, serious illness affecting staffing, utility failure, fire, flooding, pandemic-related restrictions, serious technical failures, or other comparable events.
We will take reasonable steps to minimise disruption and communicate material impacts where reasonably possible. Your rights in the event of force majeure are not excluded where mandatory law provides otherwise.
These Terms and any agreement for Services are governed by Dutch law. Any dispute will be submitted to the court that has jurisdiction under applicable Dutch law; this does not restrict a consumer's rights under mandatory rules on jurisdiction.
If a provision of these Terms is invalid, void, or unenforceable, the remaining provisions remain in effect. We will replace the affected provision with a lawful provision that comes as close as possible to its original purpose and economic effect.
A delay or failure by us to enforce a provision does not mean that we waive the right to enforce it later. These Terms do not create rights for third parties except where mandatory law provides otherwise.
Complete and return this form only if you wish to withdraw from an agreement concluded at a distance or away from our Studio.
